Terms of Service for Creare AI

Agreement to Terms: By accessing or using the Creare AI mobile application, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the App.
1. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.
- You must provide accurate and complete information
- You are responsible for maintaining account security
- You must not share your account credentials
- One account per person
2. Service Description
2.1 AI Image Generation
- Generate images using AI based on text prompts
- Use credits to create images
- Store images in your personal gallery
- Edit and enhance images with AI tools
2.2 Credits System
- Credits are virtual currency used for image generation
- Credits are consumed when generating images
- Credit cost varies by image resolution and features
- Credits do not expire
- Credits are non-refundable (except as required by law)
2.3 Subscription Tiers
- Free - Limited credits and features
- Basic - $4.99/month, 100 credits/month
- Standard - $14.99/month, 450 credits/month
- Premium - $29.99/month, 1000 credits/month
- Professional - $59.99/month, 1500 credits/month
2.4 Credit Packs
- One-time purchases of credits
- Small (50), Medium (220), Large (600) packs available
- Credits stack with subscription credits
- Credits never expire
3. Payments and Billing
3.1 Subscription Payments
- Subscriptions are billed monthly
- Automatic renewal unless cancelled
- Charged through Apple App Store or Google Play Store
- Prices may change with 30 days notice
3.2 Cancellation
- Cancel subscription anytime through App Store/Play Store
- Access continues until end of billing period
- No refunds for partial months
- Unused credits remain in your account
3.3 Refunds
- Refunds handled by Apple or Google according to their policies
- Contact Apple/Google for refund requests
- We may provide refunds at our discretion for service issues
4. Acceptable Use
4.1 Permitted Use
You may use the App to:
- Generate images for personal or commercial use
- Create artistic and creative content
- Edit and enhance images
- Store and organize your generated images
4.2 Prohibited Use
You may NOT:
- Generate illegal, harmful, or offensive content
- Create images depicting minors in inappropriate situations
- Generate content that violates others' rights
- Use the Service for spam or malicious purposes
- Attempt to reverse engineer the App
- Share or resell your account access
- Abuse or exploit the Service
- Generate deepfakes or misleading content
4.3 Content Restrictions
Prohibited content includes:
- Child sexual abuse material (CSAM) - ZERO TOLERANCE
- Non-consensual intimate images
- Extreme violence or gore
- Hate speech or discriminatory content
- Harassment or bullying
- Illegal activities
- Copyrighted material without permission
5. Intellectual Property
5.1 Your Content
- You retain ownership of prompts you create
- You retain rights to images you generate
- You grant us a license to process and store your content
- You are responsible for ensuring your prompts don't infringe others' rights
5.2 Generated Images
- Images are generated using AI (Stability AI and Replicate)
- You receive a license to use generated images
- Commercial use is permitted for paid subscribers
- Free tier users: personal use only
- Attribution is not required but appreciated
5.3 Our Intellectual Property
- The App, logo, and branding are our property
- You may not copy, modify, or distribute the App
- You may not use our trademarks without permission
6. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not guarantee:
- Uninterrupted or error-free service
- Specific image quality or results
- Accuracy of AI-generated content
- Compatibility with all devices
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. Our total liability shall not exceed the amount you paid in the last 12 months, or $100, whichever is greater.
8. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect and use your information.
9. Dispute Resolution
9.1 Governing Law
These Terms are governed by the laws of Turkey, without regard to conflict of law principles.
9.2 Informal Resolution
Before taking legal action, contact us at contact@creareai.art to resolve the dispute informally.
10. Changes to Terms
- We may update these Terms at any time
- Material changes will be notified via email or in-app
- Continued use constitutes acceptance
- 30 days notice for material changes
12. Apple and Google Terms
12.1 Apple App Store
If you download the App from Apple App Store:
- These Terms are between you and us, not Apple
- Apple has no obligation to provide support
- Apple is not responsible for the App
- You comply with Apple's Terms of Service
12.2 Google Play Store
If you download the App from Google Play:
- These Terms are between you and us, not Google
- Google has no obligation to provide support
- Google is not responsible for the App
- You comply with Google's Terms of Service

BY USING CREARE AI, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
